Welcome to Aquasolar. By accessing and using this site, you agree to comply with and be bound by the following terms and conditions of use. These terms, along with our privacy policy, govern our relationship with you concerning this website and the services we offer. We may update these terms from time to time, and it is your responsibility to review them regularly. By continuing to use our site and Products and services after any changes, you accept and agree to the updated terms.
Definitions
• Company: Aquasolar
• Customer: The individual or entity purchasing products or services from the Company.
• Products: Solar water heating systems and related components provided by the Company.
• Services: Installation, maintenance, repair, and warranty services provided by the Company.
• Installation: The process of setting up the Products at the Customer’s premises.
• Warranty: The Company's guarantee regarding the quality and performance of the Products.
2. Scope of Services
The Company agrees to provide the Customer with Products and Services as specified in the order confirmation. Installation services include delivery, setup, and initial testing of the Products at the Customer’s location. Maintenance and repair services are available as specified in a separate agreement.
3. Pricing and Payment Terms
• Pricing: The prices for Products and Services are listed in the order confirmation and include
applicable taxes unless otherwise stated.
• Deposit: A 70% deposit is required upon acceptance of the order.
• Payment: The balance is due on completion of the of installation. Payments can be made via EFT or SnapScan
• Late Payment: Late payments are subject to a 2% Late Fee charge per month.
4. Non-Payment of Services
• Notification: In the event of non-payment, the Customer will receive a formal notice demanding
payment within 7 days.
• Suspension of Services: The Company reserves the right to suspend ongoing services or support
until full payment is received.
• Repossession: The Company may, after giving written notice and in accordance with the law,
repossess the installed Products if payment is not received within 30 days following the initial
notice. The Customer will be liable for any costs associated with repossession.
• Legal Action: The Company reserves the right to pursue legal action to recover outstanding
payments, including but not limited to the costs of collection, attorney fees, and court costs.
5. Installation and Delivery
• Schedule: Installation will occur on a mutually agreed-upon date. The Company will make every effort to meet the delivery schedule but is not liable for delays due to unforeseen circumstances.
• Prerequisites: The Customer is responsible for ensuring that the installation site meets all necessary conditions as specified by the Company prior to the installation date.
6. Ownership and Risk
• Ownership Transfer: Ownership of the Products transfers to the Customer upon full payment.
• Risk Transfer: Risk of loss or damage transfers to the Customer upon delivery and installation of the Products.
7. Warranty and Liability
• Warranty: The Company provides labour for 60 day from the installation date. This warranty covers
workmanship.
• The Manufacturer of the product provides the warranty for materials and the Company cannot be
held liable for any defects for said Materials. All warranties are displayed on the products
themselves.
• Exclusions: The warranty does not cover damage due to improper use, unauthorized repairs, or
natural disasters.
• Liability: The Company's liability is limited to the repair or replacement of defective Products. The
Company is not liable for indirect, incidental, or consequential damages.
8. Maintenance and Support
The Company offers maintenance services on installed unit. The Customer is responsible for routine care and maintenance of the Products if called upon.
9. Unforseen Costs
Quotation excludes additional hiring of heavy duty machinery which may be required for unforeseen circumstances which become apparent after commencement of work. Should machinery be required for any such circumstances this will be brought to client’s attention for approval and cost.
10. Termination
• By the Company: The Company may terminate this agreement for non-payment or breach of
contract.
• By the Customer: The Customer may terminate this agreement by providing 10 days' written notice.
• Consequences: Upon termination, the Customer must return any Products not fully paid for or pay
any outstanding balances.
11. Dispute Resolution
Disputes shall be resolved through negotiation in good faith. If unresolved, the parties agree to submit the dispute to mediation or arbitration before pursuing legal action.
12. Force Majure
The Company is not liable for delays or failure to perform due to events beyond its control, including but not limited to natural disasters, strikes, or government actions.
13. Amendments
The Company reserves the right to amend these terms and conditions. The Customer will be notified of any changes in writing 30 days prior to their implementation.
14. Privacy and Data Protection
The Company is committed to protecting Customer data. Personal information collected will be used solely for order processing and service delivery, in compliance with relevant data protection laws.
15. Indemnity
The Customer agrees to indemnify and hold the Company harmless against any claims or damages arising from the Customer’s use of the Products or Services.
16. Entire Agreement
These terms and conditions, along with the order confirmation, constitute the entire agreement between the Company and the Customer.
